What Data residency means
Residency is a question about location, and it is often confused with two neighbouring questions it does not answer. It is not the same as sovereignty, which asks which legal system can compel access regardless of where the disks are. And it is not the same as the transfer rules of data protection law, which govern whether personal data may leave a territory rather than where it sits.
A provider can be entirely honest about running in a European region while still being subject to a non-European parent company’s legal obligations, and a buyer with a sovereignty concern rather than a residency concern will not be satisfied by a region selector. Asking which of the two is at issue is usually the fastest way to shorten a procurement conversation.
Residency requirements also vary in granularity. "Inside the EU" is a common bar and is satisfied by any European region. "Inside this specific country", which appears in parts of the public sector and healthcare, is a materially different requirement that most multi-tenant services cannot meet without a dedicated deployment.
How Enclessa uses it
